Operator: Hangzhou Liansu Technology Co., Ltd. (“we”, “us”, or “WinTalk”)
1. Acceptance
By registering for, signing in to, or using WinTalk instant messaging services (the “Services”), including clients on all supported platforms and related web features, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not register for or use the Services. When registering, you must check the box agreeing to these Terms and the Privacy Policy.
2. The Services
WinTalk provides instant messaging and related features, including one-to-one and group chats, friends and groups, text and media messages, file transfer, location messages, multi-device login, and multi-node (space) connections. The Services do not include voice or video calling. We may improve, change, or suspend features. We work to keep the Services available but do not guarantee uninterrupted or error-free operation.
3. Accounts and age
The Services are only for users aged 16 and over. You must provide accurate registration information (such as an email address) and keep your password and verification codes secure. You are responsible for risks arising from failure to protect your credentials. You may delete your account through the in-app flow (e.g. Account & security → Delete account). You must accept the Account Deletion Notice; cooling period, restore, and data handling are described there and in the Privacy Policy.
4. Prohibited conduct
You agree not to use the Services to:
- Send spam or harassing messages, or scam, phish, or otherwise defraud others;
- Promote violence, terrorism, or extremism in chats, groups, or other content visible to others;
- Post illegal pornographic content;
- Engage in any child sexual exploitation or abuse of minors;
- Engage in activities widely recognized as illegal in most countries, including selling or offering illegal goods or services (e.g. drugs, firearms, forged documents);
- Scrape, crawl, or bulk-export data without authorization, or abuse APIs to disrupt the Services;
- Attack, compromise, or otherwise interfere with the Services, nodes, or others’ devices or accounts;
- Impersonate others, falsify identity, or infringe intellectual property, publicity, privacy, or other rights;
- Otherwise violate applicable law or these Terms.
We may restrict messaging, limit features, or suspend or permanently terminate accounts for violations, with or without prior notice (especially in emergencies or where required by law).
5. User content
You are legally responsible for content you send, upload, or share. Do not send content you have no right to send. To provide the Services, you grant us a limited, non-exclusive license to use, store, copy, and transmit that content as needed. That license ends, to a reasonable extent, when you delete the content or your account and we finish processing it under our rules (except backups and retention required by law). We may offer complaint and report tools and may handle content and accounts under law and these Terms.
6. Nodes and third parties
WinTalk can connect to nodes (spaces) run by organizations or individuals. Node operators may set additional rules; when you use a node you must also follow those rules. These Terms cover our clients and the platform we operate. The Services may rely on third parties (push, email, maps, object storage, etc.). Those parties process data under their own terms and privacy policies; see the Third-Party Sharing List and the Privacy Policy.
7. Disclaimers and limitation of liability
- The Services are provided “as is” and “as available”;
- We are not liable, to the extent permitted by law, for losses caused by force majeure, network failures, third-party outages, your devices or actions, or your breach of these Terms;
- Our total liability to you is limited as required by mandatory law. Some jurisdictions do not allow certain disclaimer or liability limits; in those places such limits may not apply.
8. Termination
You may stop using the Services and delete your account at any time. If you seriously or repeatedly violate these Terms or applicable law, we may suspend or terminate all or part of the Services for you. Upon termination, your right to use the Services ends immediately, except for data we must retain by law or under the Privacy Policy.
9. Changes
We may update these Terms. Material changes will be announced in-app, via About, or by other reasonable means. If re-confirmation is required, the product flow will guide you. Continued use after changes means you accept the updated Terms, unless law requires otherwise.
